The Strata Titles Amendment Act, which came into effect on May 1st 2020, states that the Strata Manager has no authority to act, unless that authority is expressly given to them by the Council of Owners. The Strata Manager should be advising appropriate actions for the Council and the Owners, however, it is not the Strata Manager’s responsibility to ensure that these actions are enforced, it is the responsibility of the Owners.
Therefore, the question remains, if the Strata Company isn’t complying with the Act, which party is held responsible for non-compliance?
Ultimately, the responsibility lies with the Owners, as all compliance is self-regulated. Any owner can make an application to the State Administrative Tribunal to seek an order on the Strata Company, if required.
